Acceptance of These Terms

By visiting or using the Drugstore website at drugstore.cafe, placing an order, downloading our mobile app, joining our loyalty program, or signing up for our emails or texts (together, the “Services”), you agree to these Terms of Use (the “Terms”). If you do not agree, please do not use the Services.

The Services are operated by Drugstore Inc., a Delaware corporation authorized to do business in New York (“Drugstore,” “we,” “us” or “our”), 418 Broadway #8089, Albany, NY 12207, USA, together with our subsidiaries that operate Drugstore locations. Our West Village location at 172 West 4th Street, New York, NY 10014 is operated by Drugstore West Village LLC, which may enforce these Terms too.

We may update these Terms from time to time. The date at the top of this page shows when they last changed. If you keep using the Services after an update, you accept the new Terms. If we make a material change, we will tell you in a reasonable way, such as a notice on the site or an email.

Privacy Policy

Your use of the Services is also governed by our Privacy Policy, which explains what information we collect and how we use it. It is part of these Terms. By using the Services, you consent to the collection and use of your information as described there.

Restrictions on Use of Materials

Everything on the Services belongs to Drugstore or our licensors: the text, menus, recipes, photographs, graphics, logos, names, designs, software and the overall look of the site and app (the “Materials”). They are protected by copyright, trademark and other laws. “Drugstore” and our logos are our trademarks, and you may not use them without our written permission.

You may view, print or store Materials for your own personal, non-commercial use, as long as you keep all copyright and trademark notices intact. You may not copy, modify, distribute, sell, republish, scrape or create derivative works from the Materials, or use automated tools to access the Services, without our express written consent. You also may not interfere with the Services, attempt to gain unauthorized access, or use them for anything unlawful.

Geography

The Services are intended for people in the United States. Our physical locations, menus and offers are for U.S. customers. If you use the Services from outside the U.S., you are responsible for following your local laws, and we make no promise that the Services are appropriate or available where you are.

Submitted Content

We love hearing from you. If you send us comments, reviews, photos, ideas, suggestions or other content through the Services, by email, or on social media tagged to us (“Submissions”), you agree that:

We may remove any Submission at any time, for any reason. Please do not send us anything unlawful, harassing, misleading or that includes someone else’s personal information.

Online Ordering

Pickup orders. The Services let you place orders for pickup at participating Drugstore locations. Availability, hours and menus vary by location and can change without notice. Orders are prepared for the pickup time shown at checkout, and we may cancel or adjust an order if an item is unavailable or a location closes unexpectedly, in which case we will refund any amount you have paid for the affected items.

Pricing and payment. Prices are shown at checkout and may differ from in-store prices. Taxes and any fees are added at checkout. Payments are processed by our third-party payment processor, and you authorize us to charge the payment method you provide. We do not store your full card number. You confirm that you are authorized to use the payment method.

Allergens and dietary needs. Our kitchen handles common allergens, including milk, eggs, tree nuts, peanuts, wheat, soy, fish, shellfish and sesame, and we cannot guarantee that any item is free of them. Nutritional and dietary descriptions on the Services are approximate. If you have an allergy or dietary restriction, please tell us before you order, and use your own judgment.

Cancellations and refunds. Because our food is made fresh, orders generally cannot be changed or canceled once preparation begins. If something is wrong with your order, contact the location or us at admin@drugstore.cafe promptly, and we will make it right, which may mean a replacement, credit or refund at our discretion.

Promotions. Promo codes and offers are limited to one per order unless stated otherwise, have no cash value, cannot be combined unless stated, and may be withdrawn at any time. Abuse of promotions may lead to a canceled order or a suspended account.

Mobile App and Loyalty Program

Mobile app. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Drugstore mobile app on devices you own or control, for personal use. You may not copy, reverse engineer, or resell the app. We may update the app at any time, and updates may add, change or remove features. If you download the app from the Apple App Store or Google Play, you acknowledge that these Terms are between you and Drugstore only, not Apple or Google, who have no obligation to support the app, and who are third-party beneficiaries of these Terms with the right to enforce them against you. You must also comply with the terms of your app store and wireless carrier.

Loyalty program. Members may earn points or rewards on qualifying purchases as described in the app or in our program rules. Points have no cash value, cannot be sold or transferred, and may expire as stated in the program rules. Rewards are limited to one account per person. We may change, suspend or end the program, and adjust or void points or rewards obtained through error, fraud or misuse, at any time, to the extent permitted by law.

Your account. You are responsible for keeping your login details secure and for all activity under your account. Please tell us right away if you think your account has been used without your permission.

Email and Text-Message Marketing

Email. If you sign up, we will send you news, menus, offers and updates by email. You can unsubscribe at any time using the link in any message or by emailing admin@drugstore.cafe.

Text messages. By giving us your mobile number and opting in on our site, app or in store, you agree to receive recurring automated marketing text messages from Drugstore at that number, including offers, loyalty updates and order notifications. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply. Reply STOP at any time to cancel and HELP for help. Carriers are not liable for delayed or undelivered messages. Our SMS terms and privacy practices are described in our Privacy Policy, and we do not share mobile numbers or SMS consent with third parties for their own marketing.

If you change or give up a phone number, please tell us so that our messages do not reach someone else. You confirm that you are the subscriber or customary user of the number you give us.

Third-Party Content, Products and Services

The Services may link to or work with websites, apps, delivery or payment providers, and other services that we do not own or control. We provide links for convenience only. We do not endorse, and are not responsible for, third-party content, products, services, privacy practices or terms. If you use a third-party service, you do so at your own risk and under that party’s terms.

Disclaimer

THE SERVICES AND ALL MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT MENUS, PRICES, HOURS OR NUTRITIONAL INFORMATION ARE COMPLETE OR ACCURATE. Some states do not allow certain disclaimers, so parts of this section may not apply to you.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DRUGSTORE, ITS AFFILIATES, AND THEIR OWNERS, MANAGERS, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE RELEVANT ORDER OR $100. Nothing in these Terms limits liability that cannot be limited under applicable law.

Indemnity

You agree to defend and indemnify Drugstore and its affiliates against claims, losses and expenses (including reasonable attorneys’ fees) arising from your misuse of the Services, your Submissions, or your violation of these Terms or any law.

General Terms

Governing law. These Terms and any dispute relating to the Services are governed by the laws of the State of New York, without regard to conflict-of-law rules.

Disputes. Any dispute relating to the Services or these Terms will be resolved exclusively in the state or federal courts located in New York County, New York, and you consent to their jurisdiction. We encourage you to contact us first at admin@drugstore.cafe so we can try to resolve any concern informally.

Entire agreement; severability. These Terms, with the Privacy Policy and any program rules referenced in them, are the whole agreement between you and Drugstore about the Services. If any part is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign ours to an affiliate or a successor.

Copyright complaints. If you believe content on the Services infringes your copyright, send a notice with the details required by the Digital Millennium Copyright Act to admin@drugstore.cafe.
